Motor vehicle rental service (Rent a car)

Providers of motor vehicle rental services

A motor vehicle rental service is considered to be the rental of a motor vehicle category A and B without a driver (rent a car).

The conditions for providing the service of renting a motor vehicle without a driver (rent a car) are regulated by the provisions of the Law on Tourism (“Official Gazette of RS”, No. 17/2019).

Providers of motor vehicle rental services (rent a car)

Renting a motor vehicle (rent a car) can be performed by a company, another legal entity or an entrepreneur if it is registered in the appropriate register.

An association that performs the activity of renting a motor vehicle (rent a car) shall be obliged to enter that activity in the appropriate register.

The entrepreneur cannot:

  1. to perform the activity of renting a motor vehicle (rent a car) during the period of interruption of activity
  2. to start renting a motor vehicle (rent a car) before the date indicated as the start of the activity, specified in the decision of the Business Registers Agency.

Suppose the service provider performs the activity of motor vehicle rental (rent a car) in the head office, but not as principal activity. In that case, it is obliged to register a branch for that activity, that is, a different place recorded in the appropriate register.

Suppose the service provider rents a motor vehicle (rent a car) in an area outside the head office. In that case, he is obliged to register a branch or a separate place for that activity in each area, i.e. place of business, which should be registered in the appropriate register.

Insurance of users of motor vehicle rental services (rent a car)

The provider of the motor vehicle rental service (rent a car) can offer the service using various types of insurance, with the note that the same is not binding and with the obligation to provide the service user with information about the conditions and price of insurance.

The provider of the motor vehicle rental service (rent a car) who concludes an insurance policy from the service user cannot charge the amount of the insurance premium increased by the amount of the commission.

The provider of the motor vehicle rental service (rent a car) is obliged to act following the provisions of the law regulating insurance in all the cases mentioned above.

Motor vehicles

A category A and B motor vehicle cannot be older than five years, counting from the first registration day.

A provider of motor vehicle rental service (rent a car) must have at least five registered B category motor vehicles.

The provider of the motor vehicle rental service (rent a car) is obliged to display the “rent a car” sign on the motor vehicle.

Records of motor vehicles and service users

The provider of the motor vehicle rental service (rent-a-car) is obliged to keep records of motor vehicles and service users daily, according to the principles of orderliness and accuracy, in a way that does not allow the deletion of entered data, which enables insight into the data in chronological order.

The records of motor vehicles contain data on the type of service, type, i.e. model of motor vehicle, registration number, year of manufacture, date of first registration, as well as the basis of disposal of the motor vehicle (ownership, lease, leasing, etc.).

The records of service users also contain information about the service user (name and surname and contact information), the period of use of the motor vehicle, and the number and date of the issued certificate.

Legal obligations of providers of the motor vehicle rental service (rent a car)

The provider of the motor vehicle rental service (rent a car) is obliged to:

  • at the entrance to the head office, visibly display the business name and registration number, and at the entrance to the branch, i.e. separate location, the business name, head office, registration number and the name or designation of the branch, i.e. different location
  • at the entrance to the premises where the activity is carried out, visibly highlight the working hours and adhere to them in their business
  • be recorded in the Tourism Register
  • report any change in the registered data on the head office and the branch, that is, the separate place, to the appropriate registry within seven days
  • determine the general business conditions
  • make the general conditions of business available to the user of the service in each area, that is, the place of business
  • adheres to the highlighted or published general terms and conditions of business
  • issues a confirmation or concludes a contract for each contracted vehicle rental service
  • in each area, i.e. place of business, to highlight the prices of the services it provides and to adhere to the highlighted prices
  • issue a prescribed invoice for each service provided
  • to inform the user of the service in a truthful, transparent, comprehensible and non-deceptive manner in highlighting the offer, regarding the type, method of providing the service, indicated price, etc.
  • keeps records of motor vehicles
  • keeps records of services provided
  • for a period of two years, keep all documentation related to the records it keeps
  • enable the user of the service to file a complaint
  • performs activities with the attention of a good businessman.

The provider of the motor vehicle rental service (rent a car) not registered with the Business Registers Agency is obliged to report any change in the recorded data about the head office and branch, that is, a different place, to the Tourism Registry.

General business conditions of providers of the motor vehicle rental service (rent a car) and confirmation of the contracted service

The general terms and conditions of business contain the conditions and method of renting a motor vehicle, the method of payment, terms of cancellation, procedures and deadlines related to complaints, and other essential elements.

The confirmation, i.e. the contract for each contracted vehicle rental service, contains information about the service provider, confirmation number and date, type of service, service user (name and surname and contact details), motor vehicle number, type or model, with registration number, rental period, prices and others.

The general terms of business and the confirmation of the contracted service, i.e. the contract, must be in the Serbian language or bilingual, one of which is Serbian. Exceptionally, the general terms of business and the confirmation of the contracted service, i.e. the contract may be in a foreign language, but the service provider is obliged to provide their translation, certified by an authorized person.

The data contained in the general terms and conditions of business and the confirmation of the contracted service, i.e. the contract, must be accurate.

The service provider is obliged to deliver the general terms and conditions of business and the confirmation, i.e. the contract on the contracted service, to the service user directly, electronically or on a permanent record carrier.

The service user, by his signature or electronically, confirms receipt of the general terms and conditions of business and the confirmation, i.e. the contract.

The method of submitting a complaint, the procedure for submitting a complaint, etc., the provider of motor vehicle rental services operates following the regulations governing the area of ​​consumer protection.
