Conditions for performing the activity of limo service

Law on Transportation of Passengers in Road Traffic

Limo service means a public transport that is performed by a vehicle which is rented with the driver’s assistance. Conditions for performing the activity of limo service in Serbia are determined by the provisions of the Law on Transportation of Passengers in Road Traffic (“Official Herald of RS”, No 68/2015, 41/2018, 44/2018 – other law, 83/2018, 31/2019 i 9/2020).

A company or entrepreneur can perform a limo service if it has a decision of the municipal or city administration, i.e., the management in charge of traffic affairs, which determine that the company or the entrepreneur meets the requirements:

  • in respect of seat

The company fulfills the requirement for a seat if it has a seat on the territory of the local self-government, which issues the approval. The seat must include business premises where the primary business documents are stored, especially accounting documents, human resource documents, and other documents relevant to performing the activities of taxi transportation.

The entrepreneur fulfills the condition of the seat if it has a seat and residence in the territory of the local self-government unit, which issues the approval.

  • in respect of business reputation

The company does not meet the business reputation condition if the protective measure of prohibition of public transport activities prescribed by the law regulating economic offenses or law governing violations has been validly issued to a company while the measures are carried out.

The entrepreneur does not meet the business reputation condition if the protective measure of prohibition of public transport activities prescribed by the law regulating violations has been validly issued to the entrepreneur, while the measures are carried out.

A company or entrepreneur does not meet the business reputation condition if it has outstanding tax liabilities based on registered activities. Debts that are regularly settled on the basis of debt reprogramming are not considered as outstanding tax liabilities.

  • in respect of vehicles and drivers

Characteristics of passenger vehicles

Limo service can be performed only by passenger vehicles that have one of the following characteristics:

  1. Vehicle of historical importance (Old timer)
  2. A limousine that is not a serial produced and has a length of at least 7m
  3. The high-class vehicle, i.e., the luxurious car, except for vehicles with 7+1 and 8+1 seats, which is not older than five years and has a value higher than 25,000 euros, expressed in dinar counter value according to the middle course of the National Bank of Serbia on the day of submission of the request, i.e., which is not older than seven years and has a value higher than 35,000 euros, expressed in dinar counter value according to the middle rate of the National Bank of Serbia on the day of submitting the request, with the value of vehicles shall be taken the catalog value of vehicles for which as the date of production was taken the date of submission of the request
  4. A vehicle with 7 +1 or 8+1 seats and built digital tachograph, if it has emissions of at least “EURO 4”.

During the performing of limo service, in the lower-right corner of the windscreen of passenger vehicles in points 1)-3) of the preceding paragraph must be placed the board where the business name of the carrier and the word “Limo service” were written.

The condition in respect of vehicles fulfills a company or entrepreneur if it has at least one passenger vehicle, previously mentioned in points 1)-4) owned or leasing. If it meets the specified condition, the company or the entrepreneur for performing the limo service can use the remaining passenger vehicles and on the basis of lease, which cannot be shorter than six months.

Passenger vehicles that are taken to lease for a performing limo service cannot be given to a sublease. The lease agreement of the passenger vehicle must be certified by the body competent for certification if one of the contracting parties is a natural person.

The conditions in respect of the driver

The condition in respect of the driver meets a company or entrepreneur if it employs at least one driver.

The driver of the following passenger vehicles must be at least 21 years old, and he must has the driver’s license of B Category at least three years:

  1. Vehicle of historical importance (Old timer)
  2. A limousine that is not a serial produced and has a length of at least 7m
  3. The high-class vehicle, i.e., the luxurious car, except for vehicles with 7+1 and 8+1 seats, which is not older than five years and has a value higher than 25,000 euros, expressed in dinar counter value according to the middle course of the National Bank of Serbia on the day of submission of the request, i.e., which is not older than seven years and has a value higher than 35,000 euros, expressed in dinar counter value according to the middle rate of the National Bank of Serbia on the day of submitting the request, with the value of vehicles shall be taken the catalog value of vehicles for which as the date of production was taken the date of submission of the request.

Driver of the passenger vehicle with 7 +1 or 8+1 seats and with built digital tachograph, if it has emissions of at least “EURO 4” must have an qualification card of the driver or driver’s license with the written code “95”

On companies and entrepreneurs which perform transport with passenger vehicles with 7 +1 or 8+1 seats and with built digital tachograph, if it has emissions of at least “EURO 4” and on individuals who manage these vehicles, the provisions of the regulations governing the working hours of the crew of vehicles on road transport and tachographs shall be applied.
